Human Law or A Person’s Conscience
The state of nature presents to us a situation of total liberty, a free man with uncontrollable power to order their actions, disposing of their properties and their own person as they feel best (Locke, 1). It gives the man the right to equality since all are equal none is set above the other unless they by clear consensus between themselves confer it upon one to be sovereign over the others. This state of total liberty leaves in the hands of every man the right to choose that which is wrong or that which is right.
With all the trappings of absolute power over oneself, the state of nature has a law that dictates to these liberties. That is the way some would have an inner voice that would deter him or her from doing the right or wrong thing under any circumstance. Nature dictates that is an individual’s responsibility to maintain peace and preserve the well-being of all mankind. Man, who is a creation of one omnipotent and great maker must consult with the law of nature for teaching and understanding. The law of nature that govern a person’s conscience, shows a person that though all men being equal and independent should do no harm to another’s life, possessions or even liberty.
The good qualities that all men should strive to have
The good qualities that all men should strive to have so as to live in peace and harmony are brought out in the law of nature. From within a person, the issues of virtues that make him or her good citizen or person are revealed. The law of nature does give liberty but also bids it somehow. A person does not have the liberty to destroy oneself or any of his possessions. A good man preserves himself as well as his possessions.
When his wellbeing is not threatened he ought to preserve the well-being of all mankind. Just like all laws if there is no executor of the law, the laws remain useless and non-applicable (Locke, 4). So it’s the moral duty and responsibility of a good citizen to play a role in brings justice where the laws of nature have been violated. Being an executor of the law of nature, when one has power over the other and has an offender at his hands, the executor has to be very calm, reasonable and be able to listen to his right conscience so as to show restraint and serve justice. A good citizen begins with being a good person who follows good conscious truths from within himself.
Discussion
All men born into the world have a right to own their own person (Locke, 2). That is the labor of his body and the work of his hands. The law of nature give all thing on earth and the living things on it, under it, in the waters and in the skies above available for all men. When a man retrieves any of the parts of this common state of nature by hard body labor or the works of his hands, those parts are enjoined to his property. They now belong to him. Whatever it is that they retrieved from earth ceases to be available for all men and it becomes his responsibility. The creator of nature had bestowed it with great resources that were to sustain life for all mankind.
Man has now to choose how much would be enough for him and his family or get as much as he would possibly need or put to use. There is no limit as to how much power, food or money one would accumulate to meet his needs. An only good conscience and strict following of the law of nature would help get out this temptation. What a man owns and how much he owns now leads him or her to make decisions that are life-changing. By accumulating a lot more than a man can make use of it, the encroachment of rights to liberties of others by government and private entities, controversies and scandals in the financial world, greedy, selfish, and dishonest men have become our society (Locke, 5)
With these issues at hand, the society has to apply its moral obligation to bring justice and sanity to the free world. So when revolts, underappreciated genders, segregation, and government oppression became an issue, it was an individual or community responsibility to address them. The need for proper representation and desire to be free from oppression has to begin in good conscience. King of Great Britain had one of his objectives to rule over his colonies through an absolute tyranny (Declaration of Independence, p.1). The course of human events had made it necessary for the people of the United States to cut ties with their master so as to assume among the controls of the earth, the detached and equal state guaranteed under the laws of Nature which God authorizes them. They made a collective decision that impacted the whole continent.
They rebelled against their own master to be free. The need to form another union is for their preservation of life and protection of life and their own right to transact businesses, right to form their own government and the power to protect their own lives and property. They elected and authorized some of their own to make laws and rules that would guard and shield the liberties of all people of the new United States. Ultimately, these laws should be for the people to enjoy, create and own property and uphold the unity of the society.
In the event of an attack of any kind against a people or community, the same government they elected the people will be tasked with working to ease themselves from the oppression. Martin Luther King, Jr., advocated for direct action against the racist white government in Birmingham (Letter from Birmingham Jail, p.1). His conscience would not let him stay silent while the African American man faced all forms of segregation and death.
He had to go against the law of the land at that time to bring back justice and equality under the law of nature. By creating situations filled with tension, his aim was to get both parties to come to the understanding that they needed to go back to God who has made all people and they were equal before him. The freedoms that were naturally given man by God were taken from the African American because of his color through the same laws man had made.
Martin Luther king’s conscience was dictated by the responsibility to bring the true law of nature. The women of Seneca County by declaring their sentiments wanted their social, civil and religious matters taken into account by their male counterparts (Declaration of Sentiments, p1). The society had to intervene to make the man understand the law of nature where both male and female are Gods creation and should be existing together as a unit, not the man being the superior of the woman.
Conclusion
In conclusion, the law of nature should be part of a human beings inner power to consult when in need to understand the way of life. A person’s conscience, in my opinion, would be the way to follow if there was a conflict in human law and a person’s conscience.
